California law already pro- tects consumers against unauthorized distribution of this information unless a consumer consents. On top of this, automakers have strictly limited access to vehicle data to protect the public’s safety and the security of personal in- formation. Even though consumers can already grant access to maintenance and re- pair information to the vendor of their choice, SB 994 provides unfettered access to third party vendors without limiting the type of data, its scope, or how the information may be used. This bill is a solution in search of a problem and provides no guidance to consumers or automakers on what data must be provided, how it must be transmitted, and what third parties can or cannot do with vehicle data once they receive it. This bill creates a consumer informa- tion nightmare potentially greater than the recent security breaches affecting national retailers: in addition to jeop- ardizing the security of consumers’ per- sonal information, public safety could also be at risk. Disguised as consumer protection and choice, SB 994 in reality poses a tre- mendous risk to the driver and to public safety by posing a threat to the vehicle's most important safety features, includ- ing, but by no means limited to: crash avoidance, blind spot detectors and air bag deployment. By opening up the se- cure, protected technology systems in vehicles, SB 994 invites hackers, identity thieves, and other criminals to interfere with or disable safety features or emis- sions equipment. No one is suggesting that it would be a good idea for cell phone makers or other technology device manufacturers to open up their products’ data to third party vendors yet SB 994 would grant such access to the sophisticated technol- ogy that drives the cars and trucks we use today and the autonomous vehicles of tomorrow. Vehicle data is too important to grant unlimited access to anyone, especially since existing rules already cover access to necessary repair information. This bill is just too dangerous for California's drivers and the public. CNCDA opposes SB 994 because it creates data vulner- ability when the legislature should in- stead be working to prevent breaches of important consumer information. VOTE "NO" ON SB 994 B 1732 (Stone) - Dealer Advertising Modernization California's vehicle advertising laws were created to allow consumers to have a complete understanding of their obligations when making a vehicle purchase or lease decision and to ac- curately compare advertisements from different dealers. These laws have not been updated since 2002 and over the past decade dealer advertising on the Internet has exploded. Digital adver- tising now eclipses both television and print advertising, exceeding 36 percent of all dealership ads, and representing over $330 million in direct contributions to California’s economy. AB 1732 modernizes California's adver- tising laws to better protect consumers and promote fair and open markets for the sale of all vehicles. CNCDA has been working with the Department of Mo- tor Vehicles and other law enforcement entities to clarify the rules for the 21st Century and modernize them to ref lect industry's best practices. CNCDA supports AB 1732, which does all the following: • Allows dealers to advertise govern- mental and other rebates to consum- ers, such as Cash for Clunkers and the Clean Vehicle Rebate Program; • Clarifies how dealers must with- draw advertisements and allows depictions of "SOLD" on vehicle images online or in print to meet this requirement; • Balances rules for full advertising disclosures for vehicles on display at a dealership while ensuring the consumer is told of the vehicle's prior use such as a loaner or rental car; and • Clarifies that a rebate must not be advertised if it conf licts with an- other advertised rebate.
